Showing remarkable ambition, Venezuela’s leaders aspired to transform a colony that adhered to the king, the church, and tradition into a liberal republic with minimal state intervention, a capitalistic economy, freedom of expression and religion, and an elected, representative government.

Subtle but surprisingly profound changes of a liberal nature occurred, as evidenced by evolving standards of honor, appropriate gender roles, class and race relations, official conduct, courtroom evidence, press coverage, economic behavior, and church-state relations. This analysis of the philosophy of the elites and the daily lives of common men and women reveals in particular the unwritten, unofficial norms that lacked legal sanction but still greatly affected political structures.

Relying on extensive archival resources, Zahler focuses on Venezuela but provides a broader perspective on Latin American history. His examination provides a comprehensive look at intellectual exchange across the Atlantic, comparative conditions throughout the Americas, and the tension between traditional norms and new liberal standards in a postcolonial society.

This fifth volume of the Middle Works contains Ethics by John Dewey and his former colleague at the University of Michigan, James H. Tufts, which ap­peared as one of the last in the Holt American Science series of textbooks. Within some six months after publica­tion, Ethics was adopted as a textbook by thirty colleges. The book continued to be extremely popular and widely used, and was reprinted twenty-five times before both authors completely revised their respective parts for the new 1932 edition.

 

Up to the time Ethics was published, Dewey’s approach to ethics was known primarily from two short publications that were developed for use by his classes at the University of Michigan: Outlines of a Critical Theory of Ethics (1891) and The Study of Ethics: A Syl­labus (1894). Charles Stevenson notes in his Introduction to the present edition that Ethics afforded Dewey an opportu­nity to preserve and enrich the content of those earlier works and at the same time to expound his position in a more systematic manner.

Important Study of the Legal Realism Movement The history of the concept of legal realism as it evolved at Yale University Law School is in fact a history of the development of legal education in this country during the years 1927-1960, as Kalman shows in this important study. The realists' attention toward the importance of the role of litigation, the practitioner, judges and judicial reasoning, and the judiciary in a societal context represented a departure from the scientific casebook method espoused by C.C. Langdell at Harvard University Law School in the 1870s, and later supported by Roscoe Pound. Laura Kalman is a Professor of History at University of California Santa Barbara. Laura Kalman argues that factors such as budgetary constraints, university politics, personal feuds, and broader social trends may have been as important as legal theory in shaping the contours and determining the fate of legal realism at Yale. She calls her book 'a case study of the interrelationship between intellectual theory and institutional factors within the specific context of legal education.' Using legal education at Harvard as a reference point, especially Langdellian conceptualism, she sees realism as a variety of functionalism, reflecting a belief that law should be organized with reference to facts and social purposes rather than abstract legal concepts. Thus, the emergence of legal realism at Yale was, among other things, an attempt by the Yale Law School to differentiate itself from the Harvard Law School and thereby to enhance its own stature. -- Paul L.
